1. About the Service

DESIRE. ("the Platform", "we", "us", "our") is an interactive fiction reading platform that provides users with access to original novel content for reading and purchase. The Platform is operated by a business registered in Australia.

By accessing or using the Platform, you agree to be bound by these Terms of Service. If you do not agree with these terms, please discontinue use of the Platform immediately.

2. User Accounts

• You must provide accurate and truthful information when registering
• You are responsible for maintaining the security of your account credentials
• Each individual may only register one account
• You must notify us immediately if you become aware of any unauthorised use of your account
• You must be at least 18 years of age to create an account and purchase content

3. Digital Products & Purchases

Nature of Products

All content sold on the Platform consists of digital products (electronic novel chapters). Upon purchase, you will receive immediate access to the purchased content.

Payment Processing

Payments are processed securely through Stripe and Lemon Squeezy. All transactions are subject to the security protections provided by the respective payment platforms. We do not store your credit card or payment details.

Pricing

• All prices are displayed in US Dollars (USD)
• Prices may be adjusted from time to time, but previously purchased content will not be affected
• Upon purchase, you are granted permanent access to the purchased content for as long as the Platform remains operational

4. Refund Policy

Due to the nature of digital products, all purchases are final and non-refundable. However, we may consider refund requests in the following circumstances:

• Duplicate charges — if you were charged more than once for the same content due to a technical error
• Content inaccessible — if purchased content cannot be accessed due to a platform fault
• Accidental purchase — if requested within 24 hours of purchase and the content has not been accessed

To request a refund, please contact us via the in-app messaging system with your order details. We will process your request within 7 business days.

Nothing in these terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).

5. Intellectual Property

• All novel content, designs, and code on the Platform are protected by copyright
• Purchasing content grants you a personal, non-transferable licence to read the content only — you may not copy, redistribute, or use it for commercial purposes
• Unauthorised distribution of content may result in legal action
• User-generated content (such as comments and feedback) remains the property of the respective user

6. Acceptable Use

When using the Platform, you agree not to:

• Use automated tools to scrape, download, or copy content
• Attempt to bypass or circumvent access restrictions on paid content
• Share your account or transfer purchased content to others
• Post harassing, abusive, defamatory, or unlawful content
• Conduct security attacks or interfere with the normal operation of the Platform

Violation of these terms may result in your account being suspended or permanently terminated, without refund.

7. Disclaimers

• All fictional content on the Platform is entirely fictional and bears no relation to real persons or events
• While we endeavour to maintain continuous service, we do not guarantee uninterrupted availability
• We are not liable for service interruptions caused by circumstances beyond our reasonable control
• The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied

8. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claims arising from or related to your use of the Platform shall not exceed the total amount paid by you to us in the 12 months preceding the claim.

This limitation does not apply to any rights or remedies you may have under the Australian Consumer Law that cannot be excluded or limited.

9. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. Updated terms will be published on this page with a revised "Last Updated" date. Your continued use of the Platform after any changes constitutes acceptance of the updated terms.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Commonwealth of Australia, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). Any disputes arising from these terms shall be resolved through good-faith negotiation and, failing that, submitted to the jurisdiction of the courts of Australia.
